Acceptable Use Policy

This Acceptable Use Policy (‘Policy’) sets out the rules that apply when you access or use the Open Foundry platform, website, applications and related services (‘Services’). By using the Services, you agree to comply with this Policy and the Open Foundry Terms of Service.

1.Purpose of the Platform

Open Foundry provides software and services designed to connect buyers and suppliers in the manufacturing industry, facilitate RFQs, provide supplier information and offer website and enterprise services.

2.Compliance with Laws

  • You must comply with all applicable laws and regulations in every jurisdiction in which you use the Services.
  • You must not use the Services to facilitate unlawful activities, fraud, bribery, corruption, sanctions evasion, export control violations or any other illegal activity.

3.Account Security

  • You are responsible for all activities undertaken using your account credentials.
  • You must not share passwords or permit unauthorised access to your account.
  • You must take reasonable steps to protect your login credentials and notify Open Foundry promptly of any suspected unauthorised access.

4.Prohibited Uses

  • Uploading malware, viruses, ransomware or malicious code.
  • Attempting to gain unauthorised access to systems, accounts or data.
  • Scraping, crawling or harvesting platform data without written permission.
  • Using the Services, supplier profiles or platform data to create, train, improve or support a competing supplier database, marketplace, AI model or procurement platform.
  • Circumventing technical protections, security measures or rate limits.
  • Using bots, scripts or automated systems except through APIs, integrations or methods expressly authorised by Open Foundry.
  • Sending spam, phishing messages or unsolicited communications.
  • Impersonating another person or organisation.
  • Providing false or misleading company information.
  • Using the Services to infringe intellectual property rights.
  • Using the Services in a manner that is excessive, abusive or likely to adversely affect the operation of the Services or other users.
  • Manipulating rankings, reviews, analytics, verification status or any other platform metrics.

5.RFQs, Drawings and Confidential Information

  • You must only upload information that you have the right to disclose.
  • You must not upload classified information or information that is prohibited from being processed using commercial cloud services.
  • You remain solely responsible for determining whether information is subject to export controls or other restrictions.
  • You are responsible for ensuring that any technical drawings, specifications or files shared through the platform comply with applicable confidentiality obligations.
  • You must not upload information belonging to a third party unless you have all necessary rights and permissions to disclose and process that information through the Services.

6.Supplier Profiles and Company Information

  • Suppliers must ensure that all information submitted to Open Foundry is accurate, current and not misleading.
  • You must not falsely claim certifications, approvals, export licences, customer relationships, manufacturing capabilities, employee numbers, factory locations or other credentials.
  • You must not falsely represent compliance with standards such as ISO, IATF, AS9100, NADCAP or other industry accreditations.

7.Acceptable Communications

  • You must communicate professionally with other users.
  • Harassment, discriminatory behaviour, threats or abusive conduct are prohibited.
  • You must not send unsolicited marketing messages outside the functionality expressly provided by the platform.
  • You must not use contact details obtained through the Services to send mass unsolicited marketing communications.

8.Artificial Intelligence and Generated Content

  • You must not rely solely on AI-generated content without independent verification.
  • You must not use the Services to generate unlawful, misleading, deceptive or fraudulent content.

9.Restricted Content

  • Illegal content or material that promotes criminal activity.
  • Content that infringes intellectual property rights.
  • Defamatory, obscene, discriminatory, hateful or terrorist content.
  • Malware, malicious code, credential theft tools or harmful files.
  • Material that violates confidentiality obligations or trade secrets.
  • Fraudulent documentation, fake certifications or falsified business information.
  • Export-controlled or restricted information that cannot legally be processed through the Services.
  • Child exploitation material or any other content prohibited by law.

10.Monitoring and Enforcement

  • Open Foundry is under no obligation to monitor all activity on the Services.
  • Open Foundry may investigate suspected breaches of this Policy.
  • Open Foundry may remove content, suspend accounts, restrict access or terminate accounts where it reasonably believes this Policy has been breached.
  • Open Foundry may cooperate with law enforcement and regulatory authorities where required.

11.Appeals and Reporting Violations

  • Users may contact Open Foundry to request a review of enforcement actions.
  • Users should report suspected violations by contacting legal@openfoundry.app.

12.Changes to this Policy

  • Open Foundry may amend this Policy from time to time. Material changes will be published on the website and may be notified to users.
  • Additional policies and guidelines may be published by Open Foundry from time to time and will form part of this Policy where expressly stated.
